Terms and Conditions of Sale

These Terms and Conditions of Sale ("Agreement") govern the purchase and sale of the Cylinder Lifter ("Product") offered by Cylinder Lifter LLC ("Seller") to customers ("Buyer"). By placing an order and making a purchase, Buyer agrees to be bound by these terms and conditions. Please read this Agreement carefully before making a purchase.

1. Order and Payments

  • Ordering Process: Buyer may place an order for the Product through Seller's online platform. The order is subject to acceptance by Seller, and Seller reserves the right to refuse or cancel any order at its discretion.
  • Pricing: Prices for the Product are listed in US Dollars (USD) on Seller's website and are subject to change without prior notice. Buyer is responsible for paying the price displayed at the time of purchase.
  • Payment: Payment for the Product must be made in full at the time of purchase. Seller accepts the payment methods indicated on the website.

2. Shipping and Delivery

  • Shipping: Seller ships the Product to delivery addresses within the United States. Shipping costs, if applicable, will be displayed during checkout and will be borne by Buyer unless otherwise stated.
  • Delivery: Seller will make reasonable efforts to ensure timely delivery of the Product. Seller shall not be liable for delays or non-delivery caused by circumstances beyond its control, including but not limited to acts of nature or transportation delays.
  • Title and Risk of Loss: Title and risk of loss or damage to the Product pass to Buyer upon delivery. Buyer is responsible for inspecting the Product upon receipt and notifying Seller of any visible damage or discrepancy within 3 days of the date of delivery.

3. Returns and Exchanges

  • Return Policy: If Buyer is not satisfied with the Product, Buyer may return it to Seller within 30 days of the date of delivery, provided the Product is in its original condition and packaging. To initiate a return, Buyer must contact Seller's customer support and follow the return instructions provided.
  • Return Shipping: The cost of return shipping is borne by Buyer, unless the return is due to an error on Seller's part (for example, an incorrect item shipped or a product defect).
  • Refunds: Upon receipt and inspection of the returned Product, Seller will process the refund within a reasonable time, using the original payment method.

4. Warranty and Damages

  • Warranty: The Product may be accompanied by a warranty, the terms of which are provided by the manufacturer. Seller does not offer any additional warranties beyond those provided by the manufacturer unless expressly stated in writing.
  • Damages: If the Product arrives damaged or defective, Buyer must notify Seller within 3 days of the date of delivery. Seller may request evidence of the damage, such as photographs or a detailed description. Seller will review the claim and, if valid, may offer a replacement, repair, or refund at its discretion.

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SELLER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE PRODUCT, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

SELLER'S TOTAL LIABILITY TO BUYER FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE PRODUCT SHALL NOT EXCEED THE AMOUNT PAID BY BUYER FOR THE PRODUCT GIVING RISE TO THE CLAIM.

6. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming.

7. Miscellaneous

  • Entire Agreement: This Agreement constitutes the entire agreement between Seller and Buyer regarding the sale of the Product and supersedes any prior or contemporaneous agreements, communications, or understandings, whether oral or written.
  • Severability: If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: The failure of either party to enforce any provision of this Agreement shall not be deemed a waiver of its right to do so in the future.

By making a purchase, Buyer acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions of Sale.
